Bankruptcy Relief
Bankruptcy is a federal law that allows
individuals, married couples, and businesses
to eliminate or restructure their debts when
their expenses exceed their income.

Debtors often file a Chapter 13 (reorganization)
or a Chapter 7 (liquidation) bankruptcy in an
attempt to avoid paying the loan, and
sometimes in an attempt to strip existing
liens off the property. These types of filings cost
the mortgage industry millions annually to contest.

How First Pacific Servicing Can Help

First Pacific Servicing can cut down on your costs by immediately reviewing filed bankruptcies and taking aggressive measures against fraudulent and multiple filers.

You can minimize legal fees and capitalize on our bankruptcy department's ability to obtain on-going payments. Use bankruptcy as an ally to generate a monthly cash flow.

Upon a debtor’s bankruptcy filing, as soon as you say “Go!” our experienced staff will not only prepare and file your proof of claim, they will dig deep, reviewing the debtor’s bankruptcy plan and schedules. This extra step uncovers any assets that the debtor has not listed or any fraudulent activity that they may attempt.

In addition, our team of experts will aggressively seek to:
  • release the automatic stay and remove the loan from bankruptcy protection
  • proceed with foreclosure
  • obtain title to the property, if profitable or beneficial
They can also determine specific characteristics of a serial debtor, and advise you when initiating an involuntary bankruptcy is necessary.

Our Bankruptcy Department is continuously trained by attorneys for federal- and state-specific bankruptcy matters.

Bankruptcy 101

The property of the debtor is taken over by a receiver or trustee in bankruptcy for the benefit of the creditors, in accordance with the National Bankruptcy Act.

Bankruptcy allows debtors to discharge their debts; however, bankruptcy itself does not remove liens against property.

First Pacific Servicing will be your first line of defense when your debtor files a bankruptcy. Our expert bankruptcy department knows all the various actions that need to be taken to protect your claim, and will act accordingly.
